GDPR – Basic Information

EMOS spol. s r.o. processes personal data in accordance with the requirements of Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data. (General Data Protection Regulation, or GDPR).

EMOS spol. s r.o. is the controller of personal data, which it processes primarily to ensure the highest and strictest standards in the field of personal data protection and handling. We provide this basic information and are committed to upholding these standards in the company’s operations, both in our internal affairs and externally, particularly in our dealings with our customers, business partners, and third parties.

Basic Terms – Explanations

Handling of Personal Data (Processing)
Any operation or set of operations performed on personal data or sets of personal data, whether or not by automated means, such as collection, recording, organization, structuring, organizing, storing, adapting or altering, retrieving, consulting, using, disclosing by transmission, disseminating or otherwise making available, aligning or combining, blocking, erasing, or destroying. This also includes manual processing of personal data in structured files.

Personal data (data)
means any information relating to an identified or identifiable natural person (hereinafter referred to as the “data subject”); an identifiable natural person is a natural person who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, a network identifier, or one or more specific aspects of the physical, physiological, genetic, mental, economic, cultural, or social identity of that natural person.

A natural or legal person, public authority, agency, or other body that, alone or jointly with others, determines the purposes and means of the processing of personal data; if the purposes and means of such processing are determined by Union or Member State law, that law may specify the controller in question or specific criteria for its designation.

Personal Data We Process Automatically
When you visit our website, we may collect certain information about you, such as your IP address, the date and time you accessed the website, information about your web browser, operating system, or language settings. If you access our website from a mobile phone or similar device, we may also process information about your mobile device. However, to ensure your maximum privacy, information about your behavior on the website is anonymized, and therefore we cannot associate it with a specific user, i.e., a specific individual. We use Google Analytics from Google Inc. for this analytical evaluation. We then use these insights to improve the functionality and clarity of our website.

  • Marketing communications – when sending out marketing communications (newsletters), we use sub-processors. Sub-processors are bound by confidentiality and may not use your data for any other purposes. They are required to comply with the same obligations that we do.

How long do we process your personal data?

  • For the duration of the contractual relationship
  • Personal data for which consent was granted: for a period of 60 months or until consent is revoked
  • Personal data for sending the newsletter for a period of 60 months or until consent is revoked. To revoke your consent, you can use the link in the commercial communication we sent you or send an email to info@emos.cz
  • For the period required by law or legal regulations. (e.g., for tax documents, the period is at least 10 years)

Deletion
You may ask us to delete your data (this does not apply to data in documents that we are required by law to retain to defend our legal claims), backups of our systems, or backups held by our technology providers. You have the right to erasure in the following cases:

  • The data is no longer necessary for the purposes for which you gave your consent
  • You have withdrawn your consent and there is no legal basis for retaining the data
  • The personal data is being processed unlawfully
  • The obligation to erase the data is established by a specific legal regulation
  • The personal data pertains to a person under the age of 16

Objection
We process some of your personal data based on our legitimate interest. If there are specific reasons, you may object.

Restriction of processing
You have the right to restrict the processing of your personal data:

  • You dispute the accuracy of your personal data
  • We are processing your personal data unlawfully
  • We do not need the personal data for the purposes of processing
  • An objection has been raised

Data Portability Data
portability is the right of the data subject, which essentially allows them, under certain conditions, to obtain the personal data concerning them that they have provided to the company, in a structured, commonly used, and machine-readable format, and the right to transmit that data to another company—the controller.
