Contest Rules
1. General Provisions
1.1. These rules (hereinafter referred to as the “Rules”) govern the terms and conditions of marketing contests (hereinafter referred to as the “Contest”) organized by the Organizer (as defined below).
1.2. The Contests are not games of chance or lotteries within the meaning of applicable laws, as they do not require a stake or purchase.
1.3. Participation in the Contest is voluntary.
1.4. The specific terms and conditions of the Contest (in particular, its duration, the number of winners, the type of prizes, and the contest mechanics) are always set forth in the terms of the specific Contest (hereinafter referred to as the “Contest Terms”).
2. Contest Organizer
2.1. The organizer of the Contest is:

(hereinafter referred to as the “Organizer”)
2.2. The Contest is in no way operated, sponsored, or affiliated with social media platform operators (e.g., Meta Platforms, Inc.).
3. Location and Conduct of the Contest
3.1. The Contest takes place on the Organizer’s communication channels (primarily social media, websites, or other online platforms), as specified in the Contest Rules.
3.2. The Organizer will publish the Contest Rules, which include:
- the duration of the Contest,
- the conditions of participation,
- a description of the contest task,
- the number and type of prizes.
3.3. These Rules apply to each specific Contest in conjunction with the Contest Rules.
4. Participation in the Contest
4.1. The Contest is open to individuals over the age of 18 with a mailing address in the Czech Republic (hereinafter referred to as the “Participant”). Individuals under the age of 18 may participate only with the consent of their legal guardian.
4.2. Employees of the Organizer and their close relatives are excluded from participation.
4.3. The Organizer reserves the right to verify compliance with the conditions of participation.
4.4. Participants may not submit content to the Contest that:
- is in violation of legal regulations,
- infringes the rights of third parties,
- is inappropriate, offensive, or otherwise unethical.
4.5. The Organizer is entitled to disqualify, without compensation, any Participant who violates the Rules or acts contrary to good morals.
5. Winners and Prizes
5.1. The number of winners and the type of prizes are always specified in the Contest Rules.
5.2. Winners will be determined in the manner specified in the Contest Rules (e.g., by selection, random drawing, etc.).
5.3. Each Participant may win only once per Contest, unless otherwise specified.
5.4. Prizes cannot be exchanged for cash or any other form of compensation.
6. Notification and Awarding of Prizes
6.1. Winners will be contacted in the manner specified in the Contest Rules (e.g., via message or comment).
6.2. If a winner fails to provide the necessary information (e.g., shipping address) within 7 days of being contacted, the right to the prize shall expire.
6.3. The Organizer is not responsible for the delivery of the prize if the winner provides incorrect information.
7. Liability
7.1. The Organizer is responsible for the proper conduct of the Contest.
7.2. The Organizer is not liable for:
- technical issues on the part of third parties (e.g., social media platforms),
- failure to deliver messages for reasons beyond its control,
- the conduct of Participants during the Contest.
8. Processing of Personal Data
8.1. Participants’ personal data is processed by the Organizer, as the data controller, for the purpose of:
- conducting the Contest,
- evaluating the Contest,
- contacting the winners and delivering the prizes.
8.2. The scope of the data processed may include:
- first and last name,
- contact information (e.g., email, phone number),
- delivery address (for winners).
8.3. The legal basis for processing is:
- fulfillment of the Contest terms and conditions (performance of a contractual relationship),
- the Organizer’s legitimate interest (organization of the Contest).
8.4. Personal data is retained only for the time necessary to conduct the Contest and fulfill related obligations, for a maximum of 6 months after the Contest ends, unless otherwise provided by law.
8.5. Participants have the right:
- to access their data,
- to have their data corrected or deleted,
- to restrict processing,
- to object,
- to file a complaint with the Office for Personal Data Protection.
8.6. Details regarding the processing of personal data are provided in the “Personal Data Processing Policy” document on the Organizer’s website.
9. Use of Name and Entries
9.1. By participating in the Contest, the Participant agrees that, in the event of a win, their name (and city, if applicable) may be published in connection with the announcement of the Contest results.
9.2. If the Contest involves creative content (e.g., photographs, texts), the Participant grants the Organizer the right to use such content for the purposes of promoting the Contest and the EMOS brand, to a reasonable extent.
10. Final Provisions
10.1. The Organizer reserves the right to modify, shorten, extend, or cancel the Contest for important reasons.
10.2. All relationships between the Organizer and the Participants are governed by the laws of the Czech Republic.
10.3. These Rules are published on the Organizer’s website and take effect on the date of their publication.
10.4 By participating in the Contest, the Participant agrees to these Rules.
