Information on Whistleblower Protection

Pursuant to Act No. 171/2023 Coll., on the Protection of Whistleblowers (hereinafter referred to as the “Act”), effective as of August 1, 2023, which was enacted in accordance with Directive (EU) (EU) 2019/1937 of October 23, 2019, on the protection of persons who report breaches of Union law, EMOS spol. s r.o.  as an obligated entity, among other things, the obligation to establish an internal reporting system through which whistleblowers can report possible unlawful conduct that constitutes a criminal offense, an administrative offense, or unethical conduct, which the whistleblower has learned of in connection with their work or other similar activities for EMOS spol. s r.o.

EMOS spol. s r.o., within the meaning of Section 9(2)(a) of the Act, excludes the acceptance of reports from any person who does not perform work or other similar activities for the company pursuant to Section 2(3)(a), (b), (h), or (i) of the Act (i.e., dependent work performed under a basic employment relationship, military service, volunteer work, professional internship, or internship).

The persons authorized to receive and investigate reports are the HR Director and the HR Specialist

A report should include:

  • identification of the institution to which it relates
  • identification of the violation in question (as descriptive as possible)
  • the reporter’s contact information
  • any supporting materials and evidence, if applicable

Options for submitting a report through the internal reporting system:

The whistleblower may also submit a report through the external reporting system established by the Ministry of Justice.

Protection of
the Whistleblower EMOS spol. s r.o. is required by law to protect the whistleblower and other affected individuals named in the report. The relevant persons process the personal data of the whistleblower and other affected individuals mentioned in the report in accordance with the GDPR.

The internal reporting system maintains strict confidentiality regarding the whistleblower’s identity, as well as information about other individuals mentioned in the report. A key protective measure is the prohibition on taking retaliatory action against the whistleblower and other natural and legal persons (e.g., colleagues, the whistleblower’s assistants, persons close to the whistleblower, etc.).
